CONDITIONS OF USE OF THE TIK JOY SERVICE
Introduction
Welcome to TIK JOY! These Terms of Use govern the use of the TIK JOY platform, operated by TIK JOY Inc., headquartered at 1101 Madison Street, APT 503, New Jersey, United States.
By accepting these Conditions, you acknowledge that you have read and understood their contents and undertake to abide by them. If you have any doubts or questions, you can contact us at info@tik-joy.com.
Description of the Service
TIK JOY offers a technological platform that enables Users to:
- Sharing pre-configured content (e.g. promotional videos) via social networks such as TikTok or WhatsApp for rewards in the form of cashback.
- Manage accumulated credits, redeemable according to the conditions specified by the partner companies.
Access to and use of the service by Users are governed by these Terms and applicable regulations.
Registration and User Obligations
To access the service, the User must:
- Register by providing correct, up-to-date and truthful personal information.
- Ensure the security of one’s access credentials, undertaking not to share them with third parties.
The User also undertakes to
- Use the service exclusively for personal and lawful purposes.
- Do not upload content that is illegal, offensive, defamatory, discriminatory or infringes the rights of third parties, including intellectual property rights and privacy.
- Avoid any use of the service that may compromise its security, integrity or functionality.
TIK JOY reserves the right to suspend or revoke access to the service in the event of violations of these Terms and Conditions or behaviour deemed inappropriate.
How Cashback Works
The cashback provided by TIK JOY represents a monetary reward granted to Users in relation to specific actions performed on the platform, such as logging in, sharing content or other promotional activities defined by partner companies.
Nature of Payments
“Payments visible in your account are funded by Merchants; Tik Joy only facilitates payout execution via licensed payment partners. Tik Joy is not your employer nor the payer.”
Tax & Reporting
“Your tax position depends on your local law. Where EU DAC7 applies, Tik Joy may be required to report your identification and payout data to a tax authority when acting as a reporting platform operator. You consent to such reporting as required by law.”
Accumulation modalities and requirements
- Accumulation: Users only accrue the right to cashback following the complete and compliant execution of actions requested by the platform or business partners (e.g. sharing a promotional video on a social network).
- Validation: TIK JOY, through its proprietary algorithm, verifies and allocates the cashback amount based on the actions performed and the conditions set by the associated partner.
Cashback reward
- Cashback accrued by Users is credited in money directly to the bank account indicated by the User upon registration or in a dedicated section of the personal profile.
- To receive the disbursement, the User must:
- Provide a valid bank account in the same name or co-owned by the same User.
- Reaching the minimum credit threshold required for disbursement, as specified by the platform or partner companies.
- Ensure that your current account information is correct and up-to-date.
Timing and method of payment
- Payments will be made by TIK JOY within 30 working days of reaching the minimum credit threshold, unless there are technical or administrative impediments.
- The User will receive an email notification confirming the successful crediting or any issues requiring further information.
Limitations of liability
- TIK JOY is not liable for delays in the provision of cashback due to:
- Errors or incompleteness in the bank data provided by the User.
- Malfunctions of the banking system or external payment platforms.
- TIK JOY reserves the right to suspend the payment of cashback if there are well-founded doubts as to the legitimacy of the User’s activities or compliance with the requirements.
Exclusion Cases
- Users will not be able to claim cashback:
- In case of violation of these Terms of Use.
- If the accumulated credits do not reach the minimum threshold necessary for payment.
- For activities deemed fraudulent or not in conformity with the platform rules.
Transparency and support
Users can monitor the status of their accrued credits and payments directly from their account on the platform. For any queries or clarifications regarding the provision of cashback, TIK JOY provides a dedicated support service, which can be reached by email at info@tik-joy.com.
With these arrangements, TIK JOY strives to ensure a simple, transparent and User-friendly cashback system.
In the event that the User exercises his or her right of withdrawal on a purchase for which he or she has received a cashback through the TIK JOY service, the User acknowledges his or her obligation to return to TIK JOY the full amount of the cashback previously paid in respect of that purchase.
TIK JOY will be entitled to recover the amount of the cashback in any lawful manner, including by direct withdrawal from the User’s account associated with the service or, if necessary, by legal action. To enable the recovery of the amounts, the User undertakes to issue TIK JOY with any necessary proxies, including a SEPA authorisation for automatic withdrawal from the account.
The User also acknowledges that failure to fulfil this obligation will result in immediate suspension of access to the TIK JOY services, without prejudice to TIK JOY ‘s right to take legal action to recover the sums due.
Reimbursement of Promotional Expenses
By participating in the Tik Joy program, users acknowledge and accept that any monetary amounts received are not to be considered salary, wage, or taxable income, but rather lump-sum reimbursements for expenses incurred while engaging in promotional activities (e.g., data usage, connectivity, time spent). Tik Joy provides these reimbursements as a goodwill allowance to support users’ engagement with the platform. In the event that local tax authorities reclassify these reimbursements as taxable income, the user accepts full responsibility for complying with local tax laws and reporting obligations.
Tik Joy shall have no liability in this regard.
Subscription
Users may subscribe to Tik Joy membership plans, which vary in price depending on the selected subscription type.
Subscriptions grant access to several benefits, including:
a. Faster processing times for cashback payouts;
b. Reduced commission fees on cashback-related transactions;
c. Additional advantages or exclusive features that Tik Joy may introduce for subscribers from time to time.
Subscriptions are optional and can be managed directly within the user’s account settings.
Credit System
In addition to receiving cashback, users also earn credits (in the form of non-monetary points that cannot be converted to cashback).
These credits can be used to promote their videos on app.tik-joy.com, enabling them to receive support from the Tik Joy community to increase visibility and potentially earn more cashback from shared videos.
Credits are awarded when users accumulate cashback or when they actively help other community members gain likes or comments on their videos.
Limitations of Liability
TIK JOY provides the service “as is” and does not guarantee that it is error-free, uninterrupted or completely secure.
The company is not liable for:
- Misuse of the service by Users.
- Content, data or materials uploaded by Users onto the platform.
- Technical malfunctions due to external factors, such as interruptions in social network services or problems with the technological tools used.
The User agrees to indemnify and hold TIK JOY harmless from any liability arising from claims, damages or losses caused by his/her use of the Service, except in the event of gross negligence or wilful misconduct directly attributable to TIK JOY.
Merchant Funding, Insufficient Funds and Non-Payment
Merchant-Funded Rewards. Users acknowledge and agree that any cashback, payout or monetary reward visible in their Tik Joy account (collectively, “Rewards”) is funded exclusively by the applicable Merchant. Tik Joy provides a technological platform and facilitates payout execution through licensed payment partners, but does not act as payer, escrow agent, trustee or money transmitter on its own account, and does not guarantee payment from its own funds.
Condition Precedent – Availability of Merchant Funds. The accrual of a Reward constitutes the User’s claim against the Merchant, conditioned upon (i) the Merchant’s confirmation of eligibility under the campaign rules, and (ii) the availability of sufficient funds in the Merchant’s wallet or funding method connected to Tik Joy. If funds are unavailable or inadequate, payout is deferred until the Merchant replenishes its balance or otherwise provides sufficient funding.
Process in Case of Funding Shortfall. Where Tik Joy becomes aware of a funding shortfall or a refusal to fund by the Merchant, Tik Joy will use commercially reasonable efforts to: (a) notify the Merchant and request immediate top-up; (b) if enabled by the Merchant, attempt any authorized auto-top-up; and (c) mark the Reward in the User interface as “Pending – Merchant Funding Required.” Tik Joy may also suspend the Merchant’s campaigns and/or display a funding-exhausted notice until sufficient funds are restored.
Non-Payment by Merchant. If a Merchant fails or refuses to fund the Reward, Tik Joy shall have no obligation to advance or pay such Reward from its own resources. The User’s sole monetary claim for such Reward is against the Merchant. Upon request, Tik Joy will provide the User with reasonable Merchant contact details and may send reminders or notices to the Merchant; however, Tik Joy does not guarantee recovery.
Data Sharing for Resolution. To the extent permitted by law and Tik Joy’s Privacy Policy, the User authorizes Tik Joy to share minimum necessary data with the Merchant and payment partners for the purpose of payout reconciliation and recovery.
No Waiver of Other Rights. Tik Joy reserves all rights to suspend or terminate Merchant access, campaigns, and future use of the Service due to funding failures, without prejudice to any other remedies.
Payouts are contingent upon timely and sufficient Merchant funding; Tik Joy does not advance or guarantee payouts where a Merchant’s funds are unavailable, insufficient, disputed or withheld.
Rights and Duties of the User
The User has the right to:
- Access to the platform and use of the services within the limits of these Conditions.
- Receive technical assistance for any problems with the operation of the platform.
The User has a duty to:
- Use the service in a manner consistent with applicable laws and these Terms.
- Ensure that the content uploaded on the platform does not infringe third-party rights.
- Do not use the service for commercial purposes, unless otherwise authorised in writing by TIK JOY.
Changes to the Terms of Use
TIK JOY reserves the right to change these Terms at any time. Users will be given at least 30 days’ notice of any changes. By continuing to use the service after this period, you implicitly accept the new Terms.
Processing of Personal Data
TIK JOY processes your personal data in accordance with the General Data Protection Regulation (GDPR – EU Regulation 2016/679) and applicable legislation. For more details, please see our Privacy Policy available on the platform.
Applicable Law and Jurisdiction
These Conditions are governed by Italian law. For any disputes with consumer Users, the court of the place of residence or domicile of the User shall have jurisdiction, as provided for in Article 66-bis of the Consumer Code (Legislative Decree 206/2005).
